The Court held the starting point of 13 years and the resulting sentence of 8½ years after plea and limited credit for foreign custody was not manifestly excessive: the applicant executed a calculated multi‑victim investment fraud causing catastrophic loss, resisted extradition (thus limited foreign‑custody credit), and the victim impact evidence was not challenged; appeal dismissed.

Majority held that the credit card sales slips and the replies from issuing banks, once received and retained by the Hongkong and Shanghai Banking Corporation as part of its monitoring and investigative process, became matters recorded in the bank’s records and satisfied s.20 requirements (ordinary course of business and custody); consequently the copies were prima facie evidence that the transactions were unauthorised and, taken cumulatively with other evidence and admissions, sustained the convictions. The cautioned statements were properly admitted after careful judicial assessment.
