The magistrate erred in refusing costs because he expressed doubt about the complainant and indicated the appellant's evidence might be true; the appellant was off duty and his consistent explanation did not amount to bringing suspicion upon himself, therefore the appellant was entitled to his costs, to be taxed if not agreed.
