The court found Kroll and C S Wong had been engaged in breach of the 2021 CFI Orders and therefore their fees were improperly incurred and should not be borne by John; Canadian property taxes should be borne one third by each sibling so only John’s one third was to be retained with two thirds released; the two competing costs orders were to be set off leaving the sum of HK$2,444,382.01 released to John; overall the court ordered payment out of HK$5,841,690.73 to John and retention of HK$1,048,760.74 pending further accounting, and ordered costs in favour of the applicant.
