The Court held that the Lands Tribunal's treatment of a yearly tenancy as having a probable four-year duration was a permissible valuation assumption, that the Tribunal's treatment of asset values and use of WACC were valuation judgments not errors of law, and therefore the Commissioner's substantive grounds failed; however paragraph 3 of the Tribunal's second order (purporting to alter the earlier reasons) was misconceived and was set aside.
