The trial judge was entitled to accept the prosecution witnesses' credible, consistent observation that no distribution of anti-epidemic supplies occurred and that seven persons purposefully gathered around the table in a public place; absent any substantive evidence of distribution or intent to distribute, the statutory exemption did not apply, and the sentence of 14 days imprisonment suspended for 18 months was within judicial discretion and not manifestly excessive.
