The Tribunal found on the facts that the tenancy agreement is binding on the respondent company either because a new contract was made with the company after incorporation or because the company ratified/adopted the agreement (alternatively under section 122 of the Companies Ordinance); accordingly the respondent is liable for possession and arrears calculated at $28,500 per month from 1 March 2017 until delivery up of vacant possession and may be relieved from forfeiture if it pays all arrears into the Tribunal by 17 November 2017.
