The Court set aside the Guardianship Order because the Board's decision was unreasonable: it relied on or considered matters (property dispute and non-production of will) that were irrelevant to the statutory powers under s.59R, failed to give reasons for ordering confidentiality of the Added Party's letters thereby denying the Appellant a fair opportunity to respond, and the DSW was neutral and had indicated that continuation of existing care likely obviated the need for a guardianship order; accordingly no rational Board would have made the Order and there was no need to remit the matter.
