Permission to appeal out of time was refused because the short delay (about one month) was unjustified given existing legal representation, the proposed grounds of appeal lacked reasonable prospects of success on the merits as analysed by the trial judge, and granting leave would cause prejudice to the respondent (notably property price volatility); consequently neither statutory threshold in s63A was met and the summons for late leave was dismissed.
