Joinder was dismissed because the proposed intervener had no bona fide independent proprietary or possessory interest in the premises (his status was parasitic on the tenant), his estoppel arguments were plainly and obviously futile (no relevant representation or detrimental reliance by him), human rights/basic law arguments could not confer a private right of occupation on a non-tenant, and accordingly joinder would be pointless; leave to file additional evidence was unnecessary and that summons was also dismissed.
