The court exercised its discretion to refuse amendment of the notice of appeal so far as it sought relief against the applicant because the applicant had been misled and would be prejudiced; the court allowed amendment against the other parties; on the merits the variation of the Mareva injunction permitting payment of solicitors' fees was wrongly made given the plaintiffs' uncontested proprietorial claim and risk of dissipation of assets, and the variation was set aside.
