Although the defendant lacked reasonable and probable cause and acted maliciously in lodging the complaint, the claimant failed because the necessary element of a 'prosecution' was not established: mere initiation of a police investigation and obtaining search warrants did not convert the complaint into a prosecution for the tort; extension of the tort to cover investigations was not justified and should be left to the legislature.
