The appeal was allowed and convictions quashed because the identification was rendered unreliable by the prior viewing of the appellant's identity card at the police station and by inadmissible hearsay evidence; these defects made the convictions unsafe.

Convictions were unsafe and unsatisfactory because (1) similar fact evidence that Yan worked for the defendants in December was more prejudicial than probative and should have been excluded insofar as it implicated the appellant, and (2) the evidence of the prostitute lacked the necessary corroboration for events prior to 19 January and the circumstantial association with the first defendant did not amount to proof beyond reasonable doubt; accordingly the appeal is allowed and convictions and sentences are quashed.

Section 145 does not apply to a tenant who is not in occupation; the omission of 'knowingly' is not significant and liability under s.145 requires some form of immediate control or occupation over the premises, so the magistrate was correct to dismiss the case against the non‑occupying tenant.
