Because the PRC Procuratorate had invoked the statutory protest/retrial procedure which permits the same court to alter its judgment on retrial, the Intermediate Court judgment was not final and conclusive for the purposes of Hong Kong recognition and enforcement; therefore the Hong Kong proceedings were stayed pending the outcome of the Supreme People's Procuratorate's decision.
