Application dismissed: court found petitioner had taken all reasonable steps to bring the statutory demand to the debtor's attention (or in any event proved service at the Kinwick Centre would likely have been ineffective), there was no evidence the Small Claims Tribunal judgment was irregular or that the debtor had a meritorious defence, the debtor was ordinarily resident or had a place of residence in Hong Kong within the relevant three years, and the debtor had not paid or secured provable debts or bankruptcy expenses as required by section 33(1)(b). Thus annulment was not justified.
