The Tribunal held the Applicant acted unreasonably in extinguishing his business rather than relocating; the Applicant failed to prove there were no suitable alternatives or that he lacked means to relocate or rent; Replacement Premises 1 was a suitable alternative within walking distance and of similar size, and provisional payment or renting would have mitigated loss; therefore claims for loss of goodwill, forced sale of stock and storeroom rental were not caused by the resumption and are disallowed, but agreed transportation fee of HKD 4,000 is payable.
