The trial judge erred in law and in weighing the evidence by applying the greater hardship test and by failing to give adequate weight to the landlord's reasonable requirement and family separation; the tenant failed to discharge the onus under the proviso to s.53(2)(b), and on proper application of the law an order for possession should be granted.
