Although robbery of jewellery shops with firearms ordinarily attracts guideline starting points (12–15 years for imitation firearms), the court accepted the applicant had a genuine background grievance and chronic schizophrenia causing cognitive deficits affecting planning and problem‑solving; therefore the guideline range did not fit and an individualized starting point of 7.5 years was appropriate, reduced by one‑third for plea, yielding a 5 year immediate custodial sentence, balancing mitigation against the need for deterrence.

The Court held that the sentencing judge accorded insufficient weight to general deterrence and aggravating facts (bringing the weapon into Hong Kong and the risk of it falling into wrong hands), so a non-custodial sentence was outside the reasonable range; however, exercising discretion in light of post-sentence developments (delay, substantial community service already performed, job loss and ongoing therapy), the Court dismissed the Secretary's review and declined to increase the sentence.

Conviction upheld because trial evidence overwhelmingly supported guilt; sentence was manifestly excessive and was reduced applying the totality principle: possession offences (charges 2 and 3) reduced to 18 months each to be served concurrently, attempted entry (charge 4) left at 18 months with 12 months consecutive, producing a total effective sentence of 2 years; psychiatric evidence did not affect culpability because it post-dated the offences and gave no basis to show impaired mental state at the time of offending.
