On the material before the court there was a prima facie duty of confidence in the Council papers and recordings (including recordings obtained surreptitiously), damages would be inadequate and the balance of convenience favoured preserving confidentiality pending trial; accordingly the interlocutory injunction was continued until trial and the action expedited; applications to be joined were refused except the Hong Kong Journalists Association was permitted to participate at trial to make submissions.
