The court applied the prima facie test from Re Miles Aircraft and held that, given the SFC report, supporting affidavits and the public interest in investigating the collapse of Peregrine and PFIL, the affairs of both companies ought to be investigated; the discretion under s.143(1)(a) is wide and the public interest in Hong Kong's financial reputation warrants making the declaration sought.
