The MTR by‑law s32(a) is enacted under statutory authority, constitutes a limited and proportionate restriction on one mode of expression on MTR property that legitimately protects property and other users; it is not unconstitutional; the requirement of a written permit is an exception/negative averment and under s94A CPO the defendant bears the evidential burden, therefore the conviction is upheld.
