The appeal is allowed because the dance, though an exhibition of dancing (an 'entertainment'), did not fall within 'public entertainment' as defined: the organisers/performers did not have the ability to control admission or exclude members of the public in an unenclosed public pedestrian precinct, so the place was not a 'place of public entertainment' under the Ordinance and no licence was required.
