Plaintiff is the owner and the Deed of Dedication limits the Open Piazza to pedestrian passage and passive recreation; defendants' organised, noisy, equipment‑based busking exceeded that scope and constituted trespass and nuisance; defendants offered no arguable right; accordingly the interlocutory injunction should be granted and continued until trial or further order.
