Although the factual evidence (fingerprints, confession) was suspicious and supported an inference of possession, the magistrate's oral judgment disclosed an error on the fundamental issue of the onus/burden of proof such that the conviction was unsafe; accordingly the appeal was allowed and the sentence quashed.
