The court found the publications and the Apple video created a real risk of prejudice to the pending criminal trial; however, on the facts (early admission, apology, removal of materials, remedial steps, publication months before trial and no proof of positive intent to prejudice) the contempt warranted fines proportionate to culpability rather than imprisonment. The court imposed specified fines on editors and publishers and ordered costs on an indemnity basis.
