The Court held that the appellants had shown a genuine and reasonable requirement for possession under s.53(2)(b) and the respondents had not discharged the heavy burden of proving it would be manifestly not just and equitable to make an order for possession; the Presiding Officer erred by giving excessive weight to the fact of recent purchase and by disbelieving the genuineness of need, therefore the appeal was allowed and an order for possession was made (stay granted).
