On the evidence the court preferred the Plaintiffs' credible, consistent testimony and Mother’s corroboration and rejected the Defendant’s tripartite agreement. The parties formed a common intention in 1986 that beneficial shares would reflect contributions; the proved monetary contributions and conduct established a common intention constructive trust.
