The magistrate's chosen starting point (16 months before discount) was not manifestly excessive in all the circumstances including prior convictions and the public interest, but the magistrate erred in not applying the full one-third discount for the guilty plea; accordingly the original 12-month sentence was quashed and substituted with 10 months, with 7 months to run consecutively to the sentence already being served.
