The Court held that having regard to the guilty plea and the applicant's immediate and material cooperation (which led to arrest and conviction of his Hong Kong contact) a total discount of 50% from the agreed 23 year starting point was appropriate; accordingly the 17 year sentence was set aside and substituted with 11 years imprisonment.
