On the uncontested evidence of market price at the date of breach ($450 per dozen) the Registrar assessed damages at $450 x 81 = $36,450, awarded interest at 2% over prime from 30 April 1995 to date, and ordered costs to plaintiff on the District Court scale excluding costs for an unnecessary affirmation.

The appeal was dismissed because the magistrate correctly applied the Marvels guideline in principle, lawfully adjusted the seriousness downward due to absence of international breach, and the $250,000 fine was not manifestly excessive given the value of the goods, the company's size and the demonstrated prejudice to the quota system.

The Director observed the rules of natural justice, correctly applied the law in treating the holding and subsidiary as separate economic entities, his determination that the applicant breached quota utilisation conditions was not Wednesbury‑unreasonable, and the administrative sanctions imposed were proportionate to legitimate regulatory objectives; accordingly the judicial review application was dismissed.

By majority (Zimmern and Barker JJ.) the Director lawfully may formulate and apply a quota administration policy under s.3(1) and related regulations, and may require surrender of quota and refuse export licences as administrative, compensatory measures (not punitive) to protect Hong Kong's quota obligations provided the discretion is exercised bona fide, fairly and with opportunity to make representations; the applicants were given such opportunity and the application is dismissed.
