The magistrate erred in principle by adopting a 50% FOB starting point based on past convictions; the correct starting point was the 40% guideline from Marvels and after appropriate mitigation the proper sentence is fines equivalent to approximately 30% of FOB value, therefore the original fines were set aside and substituted accordingly.
