Conviction under section 53(7) is upheld because misunderstanding of solicitor's advice is not a defence though it may mitigate sentence; capital value of premises is irrelevant to fine; forfeiture must be assessed as the illegal gain (difference between new and legitimate rent) and compensation is limited to additional rent for reasonably comparable accommodation and removal costs; accordingly sentence is varied: fine reduced to HKD10000, forfeiture reduced to HKD15000, compensation reduced to HKD8000.
