The Amended Ex‑Parte Summons is dismissed because s32(3) Labour Tribunal Ordinance prevents the Court of Appeal from entertaining an appeal against a Court of First Instance refusal of leave to appeal, and there was no evidence the applicant had sought re‑opening in the Court of First Instance before perfection of the order.

Extension of time to appeal was refused because the applicant offered no explanation for the delay and failed to demonstrate any real prospect of success on the merits; the sealed dismissal of the leave application meant there was nothing viable to re-open or appeal.

The court allowed the case to be re-opened for the purpose of obtaining a single joint orthopaedic expert report to determine whether the plaintiff's neck pain was caused by the accident (triggering non-traumatic spondylosis) or was the result of pre-existing degeneration; the court appointed Dr Lau Hoi-Kuen as SJE (subject to Legal Aid approval), directed the report be produced within three months, tentatively fixed a second PTR, and ordered costs in the cause with Legal Aid taxation.
