- Citation
- HKSAR v. LAU NGAI CHU
- Court
- Court of Appeal
- Case number
- CACC228/2001
The convictions were quashed because the prosecution breached its common law disclosure duty by failing to disclose CCTV tapes that were relevant or possibly relevant to the defence, and because the particulars of the conspiracy charge failed to specify overt acts by which the alleged frauds on MasterCard and Visa were to be carried out, rendering the prosecution case insufficiently particularised; a retrial was ordered under statutory powers.
