The applicant failed to demonstrate that it would be unjust to apply the normal costs consequences: she did not provide credible or relevant reasons for refusing the sanctioned settlement offers or mediation; her listed hardships did not explain her refusals; the judgment sum was lower than the offers; accordingly the defendant's application to vary the provisional costs order is granted in part and the court will order costs in the terms approved, while refusing an oral hearing for the costs assessment and denying a counsel's certificate for the defendant's application for counsel fees.
