The court declared that the 14 March 1967 mortgage was discharged by the reassignment dated 12 April 1973 executed by the mortgagee in favour of Lui Kwai Fan; alternatively, insofar as the mortgage was not discharged by that reassignment, any estate, right, title or interest arising from the mortgage had been extinguished by the Limitation Ordinance; accordingly the plaintiff holds the property free from the mortgage and, insofar as necessary, the estate, right, title or interest of Lui Kwai Fan in the property vests in the plaintiff.
