The Court held that on the proved facts the deceased's dive to recover the cylinder was within the course of his employment or at least incidental to it because the cylinder lay on his employer's premises, his duties included recovering items from shallow water, and he had implied authority to protect employer's property; s.5(4)(b) of the Ordinance supports coverage for acts done for employer's trade, therefore the death arose out of and in the course of employment and the appeal is allowed.
