Appellate court found the magistrate had engaged in speculation about speed; on the evidence the appellant's speed was not shown to be greatly in excess of 45 m.p.h., doubt favoured the appellant, imprisonment was unjustified for this careless driving conviction, and the appropriate sentence was a fine with a reduced disqualification period.
