The trial judge's factual findings that five applicants had not made a claim for right of abode and that there was no record of any claim were upheld because applicants failed to show the findings were unsupported by evidence or that favourable evidence was overlooked; however, where material matters (eg notarial certificate, ID457 particulars and the judge's consideration of them) raised doubt as to whether the judge considered them sufficiently, the correct remedy is to set aside the finding and remit the case for reconsideration (applicant 1084).
