The court was satisfied on the evidence that the ND2A was filed by a person with no connection to the Company and was factually inaccurate and that its continued presence on the Companies Register posed a real risk of material damage and confusion for a licensed money service business; accordingly removal of the ND2A was ordered rather than mere rectification; no costs were awarded because the applicant failed to comply with Practice Direction requirements for summary assessment of costs.
