Weighing the inevitability of an adversarial valuation, the fact the valuer's conclusion was closer to the petitioner's position and that the petitioner could only achieve that price by completing the valuation, together with the adversarial conduct by both parties, the court exercised its discretion to allocate costs so that Roth pays 80% of Orlov's valuation costs and 80% of the valuer's costs, Orlov pays 20% of the valuer's costs, and TTC's costs are shared equally.
