On rehearing the court was not satisfied beyond reasonable doubt that the appellant's transient failure to observe the red light amounted to dangerous driving; the evidence supported a conclusion of careless (not dangerous) driving under s38 Cap 374, so the dangerous driving conviction was quashed and substituted with careless driving, and the disqualification order was set aside while the fine was upheld.
