The court found the Plaintiff's witnesses credible and the Defendant not credible; there was no reliable evidence that the Plaintiff or its staff received any part of the sums taken by China Asia or otherwise acted in concert with China Asia; absent evidence of collusion the statutory remedies under the MLO did not render the Deed unenforceable; accordingly judgment was entered for the Plaintiff for HK$1,999,790 with pre- and post-judgment interest at 27.6% p.a. from 23 March 2016 and costs on an indemnity basis (order nisi).
