The charging order nisi, being registered on 24 February 1970 prior to registration of the claimant's assignment, took priority under Land Registration Ordinance s3(1); the lis pendens and the judgment against Mary L. Lynn were not registrable because they did not directly affect land at the time and thus could not defeat the registered charging order; Order 50 is intra vires by virtue of Section 38(1)(j). Therefore the charging order nisi should be made absolute despite the claimant's earlier unregistered acquisition.
