On the evidence (telexes, bills of lading, agents' confirmations and conduct of respondent) the applicant proved on the balance of probabilities, with due regard to the heightened standard for fraud allegations, that the company adopted a dishonest stratagem of collecting prepaid freight and defaulting on hire and that the respondent was knowingly party to that conduct; accordingly a declaration under s275(1) was warranted and a direction under s275(2) to pay the (registered) Hong Kong judgment sums was made.
