The Court held that the Dental Council was entitled to find that directors of a dental company had professional duties to verify and ensure employed dentists were registered, that a prolonged failure (28 months spanning two annual returns) to verify and prevent an unregistered dentist practising amounted to negligent conduct of an elemental and grievous character and thereby unprofessional conduct, and that the removal orders imposed were not disproportionate.
