Although the registrar arguably erred by treating newsletter subscribers as relevant only to a differently named publication, on rehearing the court found the newsletter created only trivial goodwill (five Hong Kong subscribers) and, when combined with other evidence (Bloomberg interviews, internet hits), the total goodwill was insufficient to sustain a passing off defence under s.12(5)(a); the appeals are dismissed.
