The court found on the evidence that the applicant acquired and continued the goodwill of the predecessor business and was the sole senior user of the marks in Hong Kong; the respondent had not established use in Hong Kong sufficient to defeat the applicant's rights; consequently the respondent's registrations are invalid insofar as they cover financial and monetary services because their use would constitute passing off against the applicant.
