On the facts before the Court the plaintiff company, incorporated in the British Virgin Islands, had not established ordinary residence in Hong Kong; the court therefore had power under Ord. 23 r.1(1)(a) to order security for costs. Section 357 did not apply to the company because it was not formed and registered under the Companies Ordinance or predecessor Hong Kong ordinances.
