The court has jurisdiction to remove liquidators appointed under s.227B(1)(b) by applying s.196(1); however the applicant failed to show sufficient cause to remove the incumbent liquidators (no proven actual or reasonable perception of bias, no established serious dereliction or incompetence). The Regulating Order will not be discharged but is varied to require the liquidators to consult creditors by sending a defined report to those treated or accepted as creditors/contributories within 28 days; sealed documents remain sealed; costs ordered as to contribution by the applicant.
