The court held that the 1st/2nd Defendants, as owners/managers who retained control of the common parts, breached their duty by allowing high fire-loading combustible fittings, failing to ensure functioning sprinklers, alarms and enforcement of fire doors, and that the 4th Defendant as installer/maintainer negligently failed to ensure sprinkler gate valves were accessible and open; those breaches materially contributed to the deaths by smoke inhalation and thus liability was established, with apportionment of liability 60% to the 1st/2nd Defendants and 40% to the 4th Defendant.
